Welcome to our website. These terms and conditions together with our privacy policy form part of the Agreement between you the Client and ourselves. Your accessing of this website and/or undertaking of a purchase or commission indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.

The term "you" refers to the user or viewer of our website.

Copyright & Ownership of works

All intellectual property rights are the property of Hilton Cabinet Company Ltd trading as Hilton Studio, and you agree not to copy, reproduce, transmit, distribute or create derivative works of any part of the site/purchased goods for personal or commercial gain, nor assist any third party to distribute or commercially exploit all or any part of this site or purchased goods from Hilton Studio. We reserve the right to display and use work produced and copyrighted to Hilton Studio for promotional purposes on and offline. If you have any objection to work commissioned by yourself being used this way please contact the studio in writing.

Promotional Literature

We have made available a collection of our promotional literature throughout the site for download and print, you may not alter the content of the literature without wrtten consent and all copyright notices must be kept intact.

Promotional Usage

Hilton Studio reserves the right to use any commissioned work for use in promotional material, unless requested otherwise in writing (post/email/fax).

Payment

Cash, Personal Cheque (by prior arrangement), Paypal, Bankers Draft or BACS Transfer are all acceptable methods of payment. Our Terms are payment in full within thirty days, we usually require a 30% deposit before work can commence. All goods remain the property of Hilton Studio until paid for in full. Monies that remain outstanding by the due date will incur late payment interest at the rate of 2% above the prevailing Bank of England's base rate on the outstanding balance until such time as the balance is paid in full and final settlement. We reserve the right to seek recovery of any monies remaining unpaid sixty days from the date of invoice via collection Agencies and/or through the Small Claims Court in the event that the outstanding balance does not exceed £3000. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

Returned cheques will incur a £25 charge to cover banking fees and administrative costs. In an instance of a second Returned cheque, we reserve the right to terminate the arrangement and, if agreed to, we shall insist on future cash transactions only. Consequently, all transactions and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.

Cancellation Policy

Minimum 24 hours notice of cancellation required. Notification for instance, in person, via email, phone and/or fax, or any other means will be accepted subject to confirmation in writing. We reserve the right to levy a £30 charge to cover any subsequent administrative expenses.

Termination of Agreements and Refunds Policy

Both the Client and ourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a service is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused services, shall be refunded.

Delivery Policy

We will dispatch your order by Royal Mail or courier.

Within the UK, you can expect delivery within 7 working days from notice of completion of the work. International orders may take a little longer. Please contact us for further information on overseas charges and deliveries.

Should you pay by Paypal we reserve the right to only post items to the address registered to the PayPal account.

Returns Policy

In the event that you wish to return a product or receive a refund, you may do so within 30 days of the dispatch/completion date, as long as the item is in the original packaging and in a re-saleable condition.

Reasons for Return − Please state when contacting us for a return

• Unwanted: If the product is not a commissioned bespoke design and in a re-saleable condition, we will refund the full purchase price of the product, excluding the cost of postage. If we believe that the product has been used or if it has been opened or if the packaging has been tampered with, we reserve the right to refuse a refund or exchange.
• Incorrect: If the product we have sent is incorrect and/or not as listed, we will tell you how to return it and we will replace it free of charge as soon as possible.
• Damaged: If the product is damaged, we will tell you how to return it and we will replace it free of charge as soon as possible.

We will arrange a refund within 2 weeks once we have received the product(s). The refund will be credited to the payment method from which is was taken.

Call Monitoring

Calls to Hilton Studio may be recorded for quality assurance purposes.

Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.
